Findjobs Terms of Use

The Findjobs website, mobile application, mobile kiosk and services (collectively “Platform”) is provided by Findjobs Pte Ltd (“Findjobs”, “we”, “us”, “our”). By accessing or using the Platform, you acknowledge that you have read and understood these Terms of Use and our Privacy Policy and agree to be bound by them. If you do not wish to be bound and abide by these Terms of Use or our Privacy Policy, you should not continue to access or use the Platform.

Findjobs may make amendments to these Terms of Use and our Privacy Policy and it is your responsibility to periodically review these Terms of Use and our Privacy Policy.

Use of Platform

1. You may not copy, reproduce, republish, download, post, broadcast, transmit, make available to public, or otherwise use the content on this Platform, in full or in part, in any way without the prior written consent of Findjobs.

Violation of our Platform and/or these Terms of Use will result in civil and criminal liabilities including the violation of the Computer Misuse Act (Cap. 50A), Spam Control Act (Cap. 311A) and the Personal Data Protection Act 2012. Findjobs reserve our rights to remove any of your material as we deem appropriate without any notice or requesting your consent. We will also look to you for any recourse.

Limitation of Liability

7. In no event shall Findjobs be held responsible for any transaction between a job applicant and a job poster or in any case, transactions between users of the Platform, and users with third parties.

8. The Platform is provided on an “AS IS” and “IS AVAILABLE” basis without representation or warranty (express or implied) to the extent permitted by law, including implied warranties of satisfactory quality, fitness for purpose, non-infringement, compatibility, security and accuracy.

In addition, Findjobs shall not be liable for any delay or failure in performance resulting in anyway from causes beyond our control, including without limitation, power failure, IT network, computer, server and infrastructure failure, fires, floods, act of God, war, government actions and non-performance of third parties.

TO THE FULLEST EXTENT PERMITTED IN LAW, FINDJOBS AND ITS AFFILIATES, ASSOCIATED COMPANIES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, PROPRIETORS, PARTNERS, REPRESENTATIVES, SHAREHOLDERS, SERVANTS AND ADVISORS SHALL NOT BE LIABLE IN ANY EVENT FOR DAMAGE OF ANY KIND SUFFERED BY YOU WHATSOEVER DIRECTLY OR INDIRECTLY ARISING FROM OR RELATING TO YOUR USE OF OR INABILITY TO USE THE PLATFORM.

Indemnity

You agree to indemnify, defend and hold harmless, Findjobs and its affiliates, associated companies, officers, directors, employees, agents, proprietors, partners, representatives, shareholders, servants and advisors from and against any and all claims, actions, demands, injury, liability, losses, damages, costs and expenses (including legal expenses on an full indemnity basis) arising from or relating to your use and/or breach of the Platform or these Terms of Use. You further agree that this indemnity is separate and shall not prejudice our rights to any other rights or remedies in law.

Intellectual Property

13. All content, data, information, material, text, graphics, images, layout, designs, pictures, logos, HTML, coding, and proprietary material uploaded by you, belonging to Findjobs, or in anyway made available on the Platform shall be the intellectual property of Findjobs and is protected by copyright, trademark, patent, passing off or any intellectual property laws.

14. For the avoidance of doubt, all intellectual property rights belonging to Findjobs shall remain the proprietary rights of Findjobs at all times. Any consent provided by Findjobs for you to use any intellectual property does not transfer or create any intellectual property rights to you.

At all times, you agree not to procure, assist or facilitate others to copy, reproduce, transmit, publish, disseminate, distribute, redistribute, broadcast, circulate, store (in any medium), display, modify, sell or transfer or participate in the sale or transfer of or offer for sale of, create derivative works from, or in any way exploit any of the data and content available on the Platform, whether in part or whole. For the avoidance of doubt, any third-party conent shall not in any way be deemed as consent by Findjobs, and shall not exonerate you from the restrictions imposed in these Terms of Use.

By submitting any contribution or uploading any contribution to the Platform, you grant to Findjobs a perpetual, royalty free, exclusive, sub-licenseable right and license to use, reproduce, modify, adapt, publish, translate, create derivative works, distribute, perform, play, make available to public for commercial reasons, and exercise all copyright and publicity rights with respect to your contribution worldwide and/or incorporate your contribution in other works in any media now known or later developed for the full term of any rights that may exist in your contribution. If you do not agree to this provision, your should not upload or make available in any manner your contribution on the Platform.

Termination

17. Without limitation to any of our rights or remedies in law, Findjobs may, without notice and at our sole discretion, restrict, refuse application of, and terminate any user account, use of the Platform and our services.

Confidentiality

18. Any data and information provided by Findjobs, including Personal Data as further governed by our Privacy Policy, shall be deemed confidential and you agree to hold it in the highest confidence and only use and disclose it in accordance with the permission and direction provided by us.

Entire Agreement

20. These Terms of Use constitute the entire agreement between Findjobs and you relating to the use of the Platform and our services.

Severability

21. If any provision of these Terms of Use is deemed invalid or otherwise unenforceable, then that provision shall be severed. The remaining provision in these Terms of Use shall continue unaffected and in full force and effect.

Governing Law

22. These Terms of Use shall be governed exclusively in accordance with the laws of Singapore.
